News about Building Bonus

From next May 27 there will be news for the facilitated works of the construction sector. The amendment of the decree (dl 21/2022) was approved a few days ago and introduced more restrictive measures in the section of bonuses dedicated to construction.

Obligations for businesses

A choice that will have a great impact on the economic and organizational balance  of companies that want to benefit from building bonuses. A first brake has been put on all those companies that will participate in construction work for an amount exceeding € 70,000.00.

In order to better protect workers, the obligation to apply collective, national and territorial agreements stipulated by sector associations has been  imposed. We specify that the total amount refers only to construction work, so even if the works were to be divided between several companies but the amount should exceed  70,000.00, the companies affected by the bonus would still have  to provide for the application of the collective agreement.  There will also be an obligation to include in the deed of assignment works and in the invoices relating to the same

For the definition of construction works we refer to the reading of art. 89 paragraph 1, letter a)  and DL 21/22.

construction, maintenance, repair, demolition, conservation, rehabilitation, renovation or equipment;

transformation, renewal or dismantling of fixed works, permanent or temporary, in masonry, reinforced concrete, metal, wood or other materials, including structural parts of power lines and structural parts of electrical installations;

excavations, and assembly and dismantling of prefabricated elements used for the realization of construction or civil engineering works.

Obligations for companies: SOA

Among the novelties of the approved amendment there is another date to mark on the agenda. On July 1, 2023, the obligation to possess SOA certification will start for companies that carry out work above € 516,000, 00. In addition, the decree provides that requests for certification are made in the period from 1 January 2023 to 30 June 2023.

What are the requirements to obtain SOA certification?

The requirements are divided into 3 categories:

1. General character (professional suitability ;
2. Economic capacity;
3. Technical and professional ability;

Who issues the SOA certificate?

The certificate is issued by special Certification Bodies authorized to operate by ANAC.
